These Terms of Use ("Terms") govern your access to and use of The Best AI Chat Widget, a product of iQEverything ("we," "us," "our"). By purchasing, installing, or using the Service, you agree to these Terms.

1. The Service

The Best AI Chat Widget is an AI-powered chat product that businesses install on their websites. It answers visitor questions using content the business provides, can book appointments on a connected calendar, and can hand off conversations to a human. We provide done-for-you setup as part of the Service.

2. Accounts and Eligibility

You must be at least 18 years old and authorized to act on behalf of the business you're signing up for the Service. You're responsible for the accuracy of the information and content you provide us to build your widget's knowledge base.

3. Pricing and Billing

Standard pricing is $97/month per website, plus a one-time $197 done-for-you setup fee, billed at signup. Monthly fees are billed in advance and are non-refundable except as described in the Charter Program below or as required by law.

4. The Charter Program

For a limited group of charter businesses, the following terms apply instead of Section 3:

Charter Program enrollment is limited and offered at our discretion. We reserve the right to close enrollment at any time.

5. Acceptable Use

You agree not to use the Service to collect sensitive personal information from visitors beyond what's needed for normal customer service, to misrepresent what the AI can do to your customers, or to use the Service for any unlawful purpose. We reserve the right to suspend the Service for accounts that violate this section.

6. The AI's Limitations

The Service uses artificial intelligence, which can make mistakes. We design the Service to decline to guess when it's uncertain rather than invent an answer, but we do not guarantee the AI's responses will always be accurate, and you remain responsible for reviewing how the widget represents your business. The Service is a tool to assist your customer communication — it does not replace your own judgment on pricing, promises, or commitments made to your customers.

7. Intellectual Property

We retain ownership of the Service's underlying software and technology. You retain ownership of the content and knowledge base information you provide us. Upon a Charter Program cancellation as described in Section 4, we will provide you a copy of your knowledge base content at no charge.

8. Disclaimers and Limitation of Liability

The Service is provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, and our total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate the Service subscription with notice as described in your specific plan. We may suspend or terminate the Service immediately for violations of Section 5.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be communicated to active customers directly.
